    1. Application of the legal conditions
    These Terms and Conditions shall apply to all the products offered by ENIGMA ADVENTURES through its website.

    The products offered through this website are available for sale throughout the whole world except the following countries:

    ENIGMA ADVENTURES reserves the right to amend these Terms and Conditions, from time to time, without previous warning and according to its own requirements. These conditions will become effective upon being displayed on the website and shall take effect and will remain in force until amended and duly published on the website.

    2. Details concerning the purchase agreement

    For most purchase agreements, the contracting party is ENIGMA ADVENTURES, 13 Appelblaar, Wavecrest, Jeffreys Bay, 6330, Eastern Cape
    • Orders may only be made for the products shown on the website
    • ENIGMA ADVENTURES will confirm receipt of the request by email upon receiving the order.
    • ENIGMA ADVENTURES always reserves the right to remove any product from the website at any time.

    3. Prices and offers

    All the prices shown in the list of our products are indicated in RAND and exclude the cost of post and packaging. In countries outside South Africa will incur customs charges and import duties that are not included in the price of the item or in the cost of post and packaging and must be paid by the recipient of the goods. ENIGMA ADVENTURES shall accept no liability in respect of said obligations that must be respected by the user.

    ENIGMA ADVENTURES reserves the right to make changes to the prices and products prior to an order being placed by the user. All the products which ENIGMA ADVENTURES offer at a special price (products on offer) will be shown on the website with the following information: offer price, usual price. And it will never be able to apply other voucher codes.

    4. Terms of payment

    Payment can be made for all purchases by the following means: VISA, MASTERCARD, Instant EFT, PAYFAST and YOCO. To make payment by card as secure as possible, ENIGMA ADVENTURES uses a secure payment system encoding the information through the SSL protocol. This is approved by a digital certificate issued by our Payment Partners:

    The ENIGMA ADVENTURES server encrypts all personal data thus ensuring the privacy and security of
    the transaction.

    5. Delivery: times and costs


    Please refer to our Shipping and Delivery page to find updated information on shipping costs and times.
    • Deliveries will be made to the address provided by the user.
    • The items bought at the ENIGMA ADVENTURES online shop are delivered by courier service.
    • Once the order has left our warehouse, the user will be informed of the tracking number by email, so they can always be informed of the status of their order.
    • To avoid delivery problems (mistaken addresses, impossible to hand-deliver at the buyer’s home), it is necessary for the user to provide a telephone number.
    • If the order is returned to ENIGMA ADVENTURES because the customer did not facilitate the delivery and wants it to be resent, the client will be responsible for the repayment of the delivery service.
    • The order will be delivered to the address indicated for delivery within a period of ten working days, although once the order has left our warehouse, delivery times may change due to courier delays locally and internationally.
    • Delivery times are given as an indication and based on the services of our logistics operators.


    6. Guarantee

    ENIGMA ADVENTURES products bought through the Website are covered by South African Consumer Act and Laws governing the district of the Eastern Cape and South Africa from the date of the bill against all material or manufacturing defects during the corresponding legal period. Defects or imperfections due to incorrect use or handling of the material or the wear and tear caused by normal use of said item are not covered by this guarantee. Furthermore, reduced functionality of items, due to the design limitations of the items are also excluded from the cover of this guarantee.

    7. Returns policy

    If for any reason when receiving your order, you no longer wish to have it, you must return it to us no later than thirty (30) days following receipt. Note: ENIGMA ADVENTURES aims to show the colours of its products as close to reality as possible. However, the colour of our products may be subject to variations depending on the lights and quality of the photograph, the monitor of your computer or other factors beyond our control. If you have any questions about the colour of any of our models, do not hesitate to contact us.

    • The purchased product must not have been used.
    • The purchased product must be returned with its original packing where possible. Should the original packing no longer be available, you must replace it with a packing of a similar nature and quality.
    • The purchased product must be sent by courier to the following address no later than thirty (30) days after the date on which the order is received.

    Returns and refund conditions
    The cost of returning the ENIGMA ADVENTURES item must always be met by the customer. ENIGMA ADVENTURES shall, under no circumstances, accept items sent without the correct postal charge having been paid. It is only possible to handle refunds for products bought from the online shop on the ENIGMA ADVENTURES website. The user will receive a confirmation email when ENIGMA ADVENTURES has accepted and made the refund. Refunds will only be made in respect of the products having been returned in accordance with our refund policy.

    When the reason for the refund is due to a manufacturing defect the quality of the product, ENIGMA ADVENTURES will pay the bill in full within ten (10) working days following receipt of the product, in addition to the postage and packaging costs incurred. Furthermore, all cancelled orders will be accepted without any cost provided that ENIGMA ADVENTURES is informed of the cancellation before sending the order. Please note that orders are dispatched within four working days following the purchase. If the order has already left our warehouse, it will not be possible to cancel said order, but the buyer may request a refund after receiving it. In these circumstances, you must wait to receive it and then request a refund provided that all the above conditions are met. Please note: ENIGMA ADVENTURES makes every effort possible to show the colours of its products as close to the actual colours as possible. Nevertheless, the colour of multifunctional headgear and technical clothing may vary depending on the light and quality of the photograph, your computer screen, or other factors beyond our control. Please contact us if you have any doubts concerning the colour of our models.

    Refunds:
    Should a refund request comply with these conditions; ENIGMA ADVENTURES will reimburse the Purchase Price paid by the user for the unwanted product. Once the product has been received by ENIGMA ADVENTURES, it will take up to ten working days for the user to receive the returned amount.

    8. Retention of title

    The products shall remain the property of ENIGMA ADVENTURES until the user has paid all the amounts due in respect of the purchasing agreement in full.

    9. Customer liability

    The Customer represents and warrants that all the information provided is truthful and accurate and will be liable for any harm, direct or indirect, caused to ENIGMA ADVENTURES resulting from the incorrect nature of said information. Furthermore, the customer undertakes to render the delivery of the order possible by providing a delivery address to which the product can be delivered during normal working hours (from Monday to Friday: from 8 am to 6 pm). Failure to respect any of these conditions may result in the order being cancelled by ENIGMA ADVENTURES, without it needing to forewarn the customer and without the latter being entitled to any compensation.

    11. Governing law

    The agreement and these terms and conditions shall be governed by South African and Free State law. In the event of any dispute arising in relation to these terms and conditions or the contract, and when proving impossible to reach an agreement, both parties shall expressly submit to the jurisdiction of the Courts of Bisho.
